These Terms & Conditions ("Terms") govern your access to and use of the website, software platform, AI voice agents, AI chat agents, CRM system, automation engine, messaging services, and related services (collectively, the "Services") provided by DaitchPro LLC ("DaitchPro," "Company," "we," "our," or "us").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

DaitchPro provides an AI-powered automation platform that may include:
- AI Voice Agents (inbound and outbound)
- AI Chat Agents
- CRM system
- Funnel system
- Automation engine
- SMS messaging
- Call routing and telecommunication services

- Client communication infrastructure
The Services may be offered directly to business clients and may also be used by end customers interacting with businesses powered by DaitchPro.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you have the legal authority to enter into this agreement.
3. Account Responsibilities
If you create an account, you agree to:
- Provide accurate information
- Maintain confidentiality of login credentials
- Notify us of unauthorized use
- Be responsible for all activities under your account
DaitchPro reserves the right to suspend or terminate accounts for violations of these Terms.
4. SMS & Telecommunication Terms
By providing your phone number and opting in, you consent to receive SMS text messages and/or automated calls from DaitchPro or businesses using DaitchPro.
These messages may include:
- Appointment reminders
- Service notifications
- Customer support updates
- Account alerts
- Marketing messages (if consented)
Message Frequency
Message frequency varies depending on user interaction and service configuration. You may receive recurring messages.
Message & Data Rates
Message and data rates may apply depending on your mobile carrier plan. DaitchPro is not responsible for carrier charges.
Opt-Out Instructions
You may opt out at any time by replying: STOP. After you send STOP, you will receive a confirmation message and will no longer receive SMS messages from that campaign.

5. Call Recording Disclosure
Calls made to or through DaitchPro systems may be recorded for: quality assurance; training; compliance; analytics; dispute resolution. By continuing a call, you consent to such recording where legally permitted.
6. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Send spam or unauthorized marketing messages
- Violate TCPA or telecommunication regulations
- Upload malicious code
- Attempt unauthorized system access
- Infringe intellectual property rights
- Engage in abusive or fraudulent behavior
DaitchPro may suspend or terminate access for violations.
7. Client Responsibilities
Business clients using DaitchPro are responsible for:
- Obtaining proper consent from their customers
- Ensuring lawful use of SMS and call automation
- Compliance with applicable laws (including TCPA, HIPAA where applicable)
- Accuracy of uploaded CRM data
DaitchPro acts as a technology platform and does not assume responsibility for client compliance unless explicitly agreed in writing.
8. Payments & Subscriptions
Certain Services may require payment. By subscribing, you agree to: pay all applicable fees; provide valid billing information; authorize recurring charges if applicable. Failure to pay may result in suspension or termination.
Fees are non-refundable unless otherwise stated in writing.
9. Intellectual Property
All platform content, software, design, trademarks, AI systems, and proprietary technology are owned by DaitchPro LLC. You may not: copy; reverse engineer; resell; distribute; modify; without written permission.
10. AI-Generated Content Disclaimer
AI-generated responses may: be automated; contain errors; require human verification. DaitchPro does not guarantee 100% accuracy of AI outputs. Users are responsible for reviewing automated communications where necessary.
11. Limitation of Liability
To the maximum extent permitted by law, DaitchPro shall not be liable for: indirect or consequential damages; loss of revenue or profits; business interruption; carrier-related delivery failures; system downtime beyond reasonable control.
Total liability shall not exceed the amount paid by the user in the prior 12 months.
12. Disclaimers
Services are provided "AS IS" and "AS AVAILABLE." We do not guarantee: uninterrupted operation; carrier message delivery; error-free AI responses; regulatory compliance by clients.
13. Termination
We may suspend or terminate access at any time for: violations of these Terms; non-payment; legal requirements; security risks. You may terminate your account subject to subscription terms.
14. Privacy
Your use of the Services is also governed by our Privacy Policy.
15. Governing Law
These Terms shall be governed by the laws of the State of Maryland, United States, without regard to conflict of law principles.
16. Changes to Terms
We may update these Terms periodically. Updated versions will be posted with a revised Effective Date. Continued use of the Services constitutes acceptance of changes.
